DEFINITIONS
User, users, the user, the users = job seeker or employer/company or any registered/non-registered visitor to the portal as applicable.
www.multimediajobs.net = the portal
Users agree that they have read and understood the Terms of Use of the portal including the specific terms for job seekers and employers/companies as applicable as well as the General Terms of multimediajobs.net before using the portal.
TERMS OF USE FOR JOB SEEKERS
By using the portal, you agree to be bound by its terms and conditions including any future amendments which may be made with/without prior intimation/notice to you.
You acknowledge that you are at least 18 years of age and are eligible to avail of services of this portal, which are offered free of cost to persons of employable age.
You agree to submit true, accurate (in all respects) and verifiable personal, academic and professional information in your profile and keep it current and updated at all times.
If the portal has any reason to believe that any false information has been furnished by you or any inconsistencies are found in your profile, the portal has every right to block all further access of the portal to you, delete your profile permanently and also contemplate further action within applicable laws.
You shall use this portal strictly in a lawful manner, for your personal use only, and for the sole purpose of searching for employment.
It is your responsibility to maintain the confidentiality of your login name and password. If you suspect any unauthorized access to, or misuse of your account, you shall report the same to the portal immediately. The portal cannot be held responsible for any breach of privacy of your profile/account with/without your knowledge in any way whatsoever.
By creating your profile on the portal, you acknowledge that your information including your personal details will be in public view of all employers/companies and is freely accessible by anyone using/visiting the portal at all times except under circumstances where you choose to control the visibility of your profile.
Before using the Block List feature on the portal, you must understand its usage and agree to its terms (please read Block List usage and disclaimer).
Registering your profile on the portal does not by itself guarantee any kind of employment whatsoever.
The portal is in NO way responsible for any response(s) you may/may not receive from any employer/company in its database.
The portal does not verify or monitor the credibility, content or activities of any employers/companies registering in its database, posting jobs, viewing profiles, downloading resumes, and/or interacting with job seekers in any manner. It is the sole responsibility of the job seeker concerned to check all the relevant particulars of an employer/company before applying to any of their jobs or accepting any offer made by them.
The portal is in NO way connected with any interview call, job selection/rejection or any such related offer/deal/agreement made/received through it. It is the sole responsibility of the job seeker to ascertain the authenticity of all such offers/agreements.
You are free to use but not abuse the privilege of creating and maintaining multiple profiles on the portal. The portal is fully empowered to deal with any indiscriminate uploading of profiles by any user by deleting all such profiles, blocking the user any further access to its services, etc without prior notice and without assigning any reason whatsoever.
TERMS OF USE FOR EMPLOYERS
Employers/companies/recruiters shall be solely responsible for the genuineness and authenticity of the jobs they post and offers they make to job seekers on the portal. Any act/offer that seeks to undermine the interests of the job seekers - like false employment claims and fake job offers - shall warrant immediate termination of the employer's account on the portal. Such an employer shall also be liable under applicable laws.
The portal is in way responsible for the quality/quantity of applications received/not received for any jobs posted on it. Employers/companies agree that displaying a job on the portal does not by itself guarantee any response. It is the entire discretion of interested job seekers to evaluate the job posted on the portal and independently decide whether to apply to it or not.
The portal cannot vouch for the genuineness or accuracy of profile(s) uploaded by any job seeker. Employers should themselves undertake any background check(s) on the job seeker(s) they shortlist, interview or select for any job(s) they post on the portal.
Employers are solely responsible for the confidentiality and privacy of their registered user name and password. If any unauthorized access or unlawful activity is suspected in any account, it is the duty of the employer/company concerned to bring the matter to the notice of the portal immediately. The portal shall in no way be liable for any costs/consequences borne/faced by the employer/company due to any breach of privacy/confidentiality of their account with/without their knowledge/consent on the portal.
Employers undertake to download resumes/profiles solely for the purpose of checking their suitability for filling their vacancies and not with any commercial intent/purpose.
Employers shall NOT take advantage of their access to job seekers' personal and contact information to send unsolicited mail/spam or make unsolicited phone calls to job seekers in order to market/ promote any products/services. The portal prohibits all such spamming/promotional activities.
The portal reserves the right to compel the employer/company to modify/delete or at its own discretion modify/delete any portion/total of the job content posted without assigning any reason whatsoever.
Jobs can be posted on the portal for free, provided they do not violate any Terms of Use. The portal shall be solely guided by own discretion in displaying any job posting for any period of time as necessitated by its circumstances. The portal reserves its right to delete any job posting without assigning any reason whatsoever and without prior notice to the concerned employer/company.
Employers/companies are solely responsible for the authenticity and accuracy of all claims/offers made in the jobs they post on the portal and agree to indemnify the portal from all claims/damages arising out of any offer/claim made by them in the jobs they post on the portal.
It is mandatory for employers/companies to register on the portal with their standard organization name and insignia. Multiple corporate identities are not only confusing but they may also prevent any job seeker from applying to the job posted by the same company under a new/different name. The portal is in no way liable for any loss of opportunities faced by job seekers owing to the multiple identities of an employer/company.
GENERAL TERMS
The portal is intended for the exclusive use of those seeking/offering employment in Multimedia, Web Designing, Animation, VFX and Gaming industries.
The portal is solely intended for use by job seekers to seek employment and by employers/companies to offer employment and fill vacancies. The portal shall not be used for any other purpose or with any commercial intent.
Users are solely responsible for all the content (including text, images, information and messages) that they upload, post or transmit through the portal. Users agree to indemnify and hold harmless the portal and all those associated with it from all claims, demands and consequences arising out of any content that they (users) post, upload or transmit through the portal.
Users agree not to post/upload any illegal, false, misleading, obscene, offensive, discriminatory, defamatory or any such unwarranted/objectionable matter/content on the portal.
While using the portal, the user shall not act in any manner that interferes with or obstructs the interests of fellow users on the portal or the portal itself in any way whatsoever including but not limited to attempting access to unauthorized user/server accounts, probing/testing the vulnerability of the system or breaching security measures without authorization, introducing virus and other malware into the system, spamming, flooding the system, etc. The portal shall seek appropriate legal recourse to hold any such users answerable for their acts of violations.
Users agree to waive all copyright/IPR (Intellectual Property Right) claims over all content uploaded by them on the portal.
The portal reserves its right to modify/reject/delete any profile/job information/data uploaded by the user without assigning any reason whatsoever without being liable to any user or third party for any such action under any circumstances.
While all efforts are made to ensure its smooth functioning, the portal cannot be held responsible for any disruptions in its service due to any failures, unforeseen technical issues/problems (including malware attack) or any factors beyond its control. Further, the portal shall NOT be liable in any way for any resultant loss/damage of information or opportunity or any consequence(s) faced/borne by the users thereof.
The portal reserves its right to decide who features in the Featured Employers and Featured Profiles panels respectively as it deems fit.
Any changes/modifications made by users – be that in a job seeker's profile or an employer's job posting - will take up to 24 hours to be updated on the portal.
The portal reserves the right to withdraw/discontinue any/all of its services either temporarily or permanently at any time without offering any reason whatsoever without being liable to anyone under any circumstances.
The portal makes no claims that the job alerts sent to a job seeker shall always be relevant to his/her profile or that the profile alerts sent to an employer shall be eternally consistent with their job requirements as posted on the portal.
Users acknowledge that the portal shall not be held responsible for any communication from its side (email, SMS, etc) being delayed/not delivered to them under any circumstances and agree to clear the portal of all liabilities for any costs/consequences borne/faced by them in any way whatsoever.
The portal prohibits any violation/infringement of intellectual property rights of any of its users and advices its users to refrain from downloading/retaining any such content that constitutes such violation/infringement.
All decisions pertaining to the portal and its services are at the final discretion of multimediajobs.net
The portal shall not be liable for any disruption/discontinuation of its services at any time under any circumstances.
In certain cases, the portal may link to third party sites with a view to improve its services to its users with no liability whatsoever for any consequences borne/faced by any users thereof.
The portal does not share personally identifiable information of its users without their prior consent with any company/third-party other than those associated with it. The portal may however disclose such information if required by law enforcement/governmental authorities or when probing any violations of its terms of use or in order to protect the property and rights of those associated with it.
Users are prohibited from including any URLs or links to their blog/website/forum while posting their profiles/jobs unless authorized by the portal. Users also agree not to link to any page(s) of the portal without seeking its prior permission.
Users shall at all times to adhere to the requirements of the Information Technology Act, 2000 and all laws and rules therein.
Users agree that any content they post on the portal can be modified/used in any other context/format/media by the portal without any prior intimation and that the portal shall not be liable for any such modifications/usage.
Reproduction, duplication, distribution, selling or publishing of any content of multimediajobs.net is strictly prohibited unless expressly consented to by the portal.
The portal shall not be part of any legal claim/dispute between the user and employer interacting through the portal. But when named in any legal proceeding, the portal shall recover all costs from those naming it in such proceedings.
All disputes between the portal and its users shall be governed by laws of India and shall fall under the exclusive jurisdiction of the courts in Hyderabad, Andhra Pradesh.
All content including logos and trademarks is property of multimediajobs.net or its respective owners. All content is provided on 'as is' basis and the portal disclaims all warranties of all kinds with regard to the content/information furnished on it.
Multimediajobs.net reserves the right to change the Terms of Use at any time without prior intimation or notice.
